The Confederation of Jews of France and Friends of Israel took note of the psychiatric expert report concerning Kobili Traoré, alleged perpetrator of the murder of Sarah Halimi defenestrated April 4 in Paris.
This report was to answer two crucial questions that were raised by this appalling affair:
- To know if, at the time of the facts, Kobili Traoré's discernment was "Total, altered or abolished",
- To know if the abominable assassination of Mrs. Sarah Halimi was motivated by the anti-Semitism of the aggressor
The Confederation of Jews of France and Friends of Israel takes note of this report, which answers both these questions.
As we said above, the first of the crucial questions raised by this case was whether, at the material time, Kobili Traoré's judgment was total, altered or abolished (which would have ended the criminal proceedings). .
The fact that psychiatric expert Daniel Zagury responded "Altered" to the question asked, suggests that Kobili Traoré will be returned to a court of assizes at the end of the investigation. This can only satisfy us and reassure us in view of the concerns arising from the beginning of the investigation.
Dr. Daniel Zagury goes on to conclude that the perpetrator was subject to "Acute delirious puff (...) induced by increased cannabis use" (ten to fifteen joints a day).
Despite this, he clearly answers the second question by concluding that "The crime of Kobili Traoré is a act delusional and anti-Semite », Which can only satisfy us because it puts an end to an interrogation which was undue and incomprehensible given the circumstances!
In view of this report, it is clear that the alleged murderer of Mrs. Sarah Halimi is responsible for his actions and that he acted motivated by his anti-Semitism.
And even so, he would have acted under the influence of narcotics (which is contradicted by the biological analyzes contained in the investigation file and which, contrary to the words of the suspect, show that the doses of narcotic drugs absorbed by the suspect are insignificant), one can not understand how this could be interpreted, criminally as a circumstance "Mitigating" even though this should be considered, on the contrary and obviously, as an "aggravating" circumstance.
In fact, is the fact that a driver is responsible for manslaughter under the influence of alcohol or narcotics not considered an aggravating circumstance (Article 221-6-1 of the Code de la Road) and in no way any mitigating circumstance in the laws of the Republic?
So why would it be different on the occasion of a savage and anti-Semitic crime?
But this is a question that only the judge and the prosecutor can and should answer us and is in no way a question that must be asked to the doctor!
The Confederation of Jews of France and Friends of Israel believes that, in the present circumstances, a second opinion would be useless to the extent that the present report allows the Public Prosecutor and the Investigating Judge to respond favorably to request of the family and the "Truth and Justice Support Committee for Sarah Halimi ": Criminal liability of Kobili Traoré and reclassification of crime with aggravating circumstance for antisemitic motivation.
However we will remain vigilant on the legal consequences of the instruction hoping that the above elements will be considered sufficient by the investigating judge to requalify the nature of this abject crime.
Finally, we look forward to the consequences of the complaint for non-assistance to people in danger.
The French, who are in love with justice and equity, and the Jewish community in France in particular, expect justice to be uncompromising in the face of all the anti-Semitic crimes committed on the national territory, crimes that are multiplying as we have seen. to demonstrate the cowardly aggression at Livry-Gargan against the family of our friend Roger Pinto.
The Confederation of Jews in France and Friends of Israel will yield nothing in its determination to fight uncompromisingly against racism and anti-Semitism.
It calls for dissuasive sanctions, the only way to put an end to the scourge of anti-Semitism.
